Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and Teve, a live video streaming and broadcasting platform operated by Siman Tech ("Siman Tech", "we", "us"). They govern your use of teve.ca, the Teve application at app.teve.ca, and the Teve API (together, the "Service").
By creating an account, subscribing, or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.
1. Accounts
- You must provide accurate registration information and keep it current, and you must be able to form a binding contract.
- You are responsible for all activity under your account and for keeping your password and API keys confidential. Notify us promptly of any unauthorized use.
- API keys carry a scope (read or write). You are responsible for requests made with your keys or user tokens.
2. Subscriptions, billing and taxes
- Paid plans are billed in advance on a monthly or annual basis through Stripe. By subscribing you authorize recurring charges until you cancel.
- Plans include limits such as the number of live streams, storage, bandwidth and IPTV channels, and unlock features such as custom domains, CDN configuration and monetization. Current plans and prices are shown at teve.ca/#pricing and may change on notice.
- Cancellation takes effect at the end of the current billing period; you retain access until then and can reactivate before it ends. Except where required by law, fees are non-refundable and partial periods are not prorated.
- Upgrades take effect immediately; downgrades take effect at the next renewal and may require reducing usage to fit the lower plan's limits.
- Prices are exclusive of taxes; you are responsible for applicable taxes other than our income taxes.
- We may suspend the Service for non-payment after reasonable notice.
3. Your content
- You retain all ownership of the live streams, videos, playlists, metadata, branding assets and other materials you provide ("Customer Content").
- You grant us a worldwide, non-exclusive licence to host, transcode, cache, package, transmit, and display Customer Content solely to operate and provide the Service (including delivery through CDNs and custom domains you configure).
- You represent that you own or have all rights, licences and permissions needed for Customer Content and its distribution, including any music, sports, broadcast or third-party rights.
4. Acceptable use
You must not use the Service to:
- Stream or store content that is unlawful, infringing, defamatory, or that you are not authorized to distribute;
- Infringe intellectual property or broadcast rights, or circumvent geographic or rights restrictions;
- Distribute malware, or attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
- Exceed, evade or manipulate plan limits or rate limits (the API allows 120 requests/minute per key or token; 60/minute on public endpoints), or place an unreasonable load on the Service;
- Resell or provide the Service to third parties except as expressly permitted by your plan (for example, white-label and OTT use);
- Use the Service for pornographic content involving minors, content promoting violence or terrorism, or other content prohibited by applicable law.
We may remove content or suspend or terminate accounts that violate these Terms, and we will cooperate with lawful requests from rights holders and authorities.
5. Third-party services
The Service integrates with third parties including Stripe (payments), CDN providers (Cloudflare, AWS CloudFront, KeyCDN, BunnyCDN), DNS and certificate authorities for custom domains, and encoder software. Your use of those services is subject to their terms, and we are not responsible for them.
6. Service availability and changes
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, add or discontinue features. We may perform maintenance, and will use reasonable efforts to limit disruption. Any service-level commitments, if offered, will be stated in a separate written agreement.
7. Suspension and termination
- You may stop using the Service and cancel at any time from your billing settings.
- We may suspend or terminate your access for breach of these Terms, non-payment, legal risk, or security reasons, with notice where practicable.
- On termination, your right to use the Service ends and Customer Content may be deleted after a reasonable period. Export your content before your account closes.
8. Intellectual property
The Service, including its software, APIs, documentation, and branding (excluding Customer Content and your white-label branding), is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. The "Powered by Siman Tech" notice and our copyright notices may not be removed.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will meet your requirements or that delivery will be uninterrupted, timely, secure or error-free.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend and indemnify us against claims, damages and costs arising from your Customer Content, your use of the Service, or your breach of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws rules. The courts located in Brampton, Ontario have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and, where appropriate, notified by email or in-app. Continued use after changes take effect constitutes acceptance.
